Abstract

This research work analyzed the institution of mediation in the context of trade relations, with particular emphasis on the importance and relevance of contain a mediation clause in the structure of the international commercial contracts for the settlement of disputes of alternately to the court or arbitral tribunal, as well as the advantages they offer. National legislation was studied by comparing it with the Model Law on International Commercial Conciliation proposal by the CNUDMI, and a small comparison was made with the law of mediation on Civil and Mercantile matters of Spain.
