The payment process in the Nicaraguan legal system

The Civil Procedure Code of Nicaragua (Law No. 902) introduced the payment process, applicable to money claims, in liquid, due, and enforceable amounts. It is a simple and agile procedure, which is available to the creditors who have a principle of documentary evidence of the credit that is intended. The purpose is to obtain an executive title faster than it is supposed to follow in a declaratory process. This investigative work exposes the main foundations of the payment process, in relation to the requirements of admission of the payment request, the position adopted by the debtor which has a legal effect, such as the execution clearance for payment, as well as the opposition that will lead to a summary trial.
